Overview

Course valid for maintaining registration in the list of custodians and delegates for sale as provided by the guidelines of the Scuola Superiore della Magistratura.

Objectives

Regulatory Framework for the Training of the Delegated Professional. The role of the delegated professional (lawyer, accountant, or notary) is governed by Article 591-bis of the Code of Civil Procedure [LEGISLATIVE DECREE 10 October 2022, No. 149] and by Article 179-ter of the implementing provisions of the same Code. The latter provision, as amended by Legislative Decree 149/2022, establishes the requirements for registration and continued inclusion in the list of professionals, including the need for “specific technical competence.” Legislative Decree No. 149/2022 further specifies that the Scuola Superiore della Magistratura prepares, every three years, the general guidelines for defining the curricula of training and refresher courses, after consulting the National Councils of the relevant professions [LEGISLATIVE DECREE 10 October 2022, No. 149].

 Continued inclusion in the list is subject to proof that the requirements are maintained, including continuing professional education, as evidenced by the provision for a three-year review of the list and the obligation to obtain a minimum number of training credits [LEGISLATIVE DECREE 10 October 2022, No. 149].

This program is structured as a “maintenance” or refresher course, aimed at ensuring that professionals already registered maintain and deepen their skills in line with legislative and case-law developments.
